Anti-Spam and Sending Policy Requirements

As the provider of an email marketing service, we take the enforcement of anti-spam laws very seriously.  When sending out emails using the software and services of Scorpion, together with its affiliates and subsidiaries, customers must comply with the applicable legislation pertaining to unsolicited communications and spam emails at each country or jurisdiction, as well as Scorpion’s anti-spam rules and sending policy, which complies with the U.S. CAN-SPAM Act.

By agreeing to Scorpion’s anti-spam rules and sending policy, you will be required to adhere to and take responsibility for the following requirements for email:

  • A visible and operable unsubscribe mechanism must be present
  • Unsubscribe requests must be honored.
  • “From” email addresses must offer an accurate representation of the sender.
  • The body of the email must include a contactable physical address.
  • You must not falsify your contact information or subject line. Make sure that your email subject line is straightforward, not misleading.
  • All emails will be identified as promotional. For example, “This advertisement was sent by ABC Company.”
  • Emails you send through Scorpion must comply with the U.S. CAN-SPAM Act, even if your business is outside the United States.

Email and Permission Practices

  • You agree to only import, access, or otherwise use contact lists that are based on consent.  Acquired mailing lists (purchased, loaned or exchanged) or lists compiled through email harvesting shall not be used.
  • You cannot mail to distribution lists or newsgroups, spam email addresses, or to subscribers that have requested to unsubscribe.
  • You are responsible for ensuring that your email campaigns do not receive a high number of abuse complaints, or a high number of hard bounces from recipients.

International Requirements
Email regulations vary by country, so you may also be subject to additional regulations depending both on the location of your business and your contacts. It’s your responsibility to ensure that you are in compliance with these additional laws and any data protection or security laws that apply.  If your business is based outside of the United States, or you have international contacts, it is recommended to identify the additional regulations by the country in which your business and your contacts are located before sending emails through Scorpion.
